These terms govern your use of our website, API testing platform, and related product APIs, including trial usage and fair use requirements.

These Terms of Service (“Terms”) are entered into by and between TOTALSHIFT LEFT TECH PRIVATE LIMITED (the “Company”, “Total Shift Left”, “we”, “us”, or “our”). These Terms govern your access to and use of our website and the Total Shift Left SaaS platform for no-code API test automation, including any related APIs, local runner, documentation, and integrations (collectively, the “Services”).

These policies are issued by TOTALSHIFT LEFT TECH PRIVATE LIMITED. Our primary website is totalshiftleft.ai. We also operate totalshiftleft.com, which is under the same company.

1. INTRODUCTION

The Services are designed for business and engineering teams to import API specifications (such as OpenAPI/Swagger), generate and manage API tests, execute tests in CI/CD or locally, and review results, coverage, and analytics. By accessing or using the Services, you agree to be bound by these Terms.

If you are using the Services on behalf of an organization, then (a) “you” includes that organization, and (b) you represent and warrant that you have authority to bind that organization to these Terms.

2. DEFINITIONS

For purposes of these Terms:

  • “Account” means your account used to access the Services.
  • “API” means any application programming interface made available by us, including product APIs used to automate workflows, trigger test runs, retrieve results, or manage resources.
  • “API Key” means any token, key, credential, or authentication method used to access the Services or APIs.
  • “Customer Data” means data, content, test payloads, API specifications, logs, artifacts, credentials, and other information you (or your users) submit to or process through the Services.
  • “Documentation” means any user guides, help pages, API references, and technical documentation we provide.
  • “Output” means results or artifacts produced by the Services, including AI-generated test suggestions, coverage reports, and execution results.
  • “Trial” means time-limited evaluation access we may make available at our discretion.

3. ACCEPTANCE AND CHANGES

By using the Services, you agree to these Terms and to our related policies, including our Privacy Policy, Cookie Policy, Security Policy, and AI Policy.

We may update these Terms from time to time. If we make material changes, we will make reasonable efforts to notify you (for example, through the Services or by email). Continued use of the Services after the effective date of an update constitutes acceptance of the updated Terms.

4. ELIGIBILITY AND AUTHORITY

You must be at least 18 years old to use the Services. If you use the Services on behalf of an organization, you represent that you have legal authority to enter into these Terms on that organization’s behalf.

5. ACCOUNTS, API KEYS, AND SECURITY

  • Account security. You are responsible for maintaining the confidentiality of your Account credentials and API Keys and for all activity that occurs under them.
  • Authorized users. You are responsible for your users’ compliance with these Terms.
  • Security incidents. You must promptly notify us of any suspected compromise or unauthorized use of your Account or API Keys.
  • RBAC and least privilege. Use role-based access controls and least-privilege configurations where available.

6. TRIAL TERMS

If we provide Trial access (including a 15-day free trial), the Trial is offered for evaluation purposes only and is subject to these Terms.

  • Duration and activation. Trial duration and start time are determined by us. For some Trials, access may be provided via a license key delivered by email.
  • Eligibility and limits. We may limit Trials to one per user or organization (or apply reasonable restrictions), and we may require business email or domain verification.
  • Evaluation-only use. Trials are not intended for production or high-risk reliance. You are responsible for validating all Outputs before use.
  • Trial fair-use caps. We may apply or adjust usage limits during a Trial, including limits on executions, concurrency, endpoint count, storage, log retention, API calls, and AI feature quotas. Any plan-specific limits shown in the product UI or Documentation are incorporated by reference.
  • No benchmarking without consent. You may not publish or disclose benchmarking, performance testing, or competitive analysis of the Services without our prior written consent.
  • Suspension and early termination. We may suspend or terminate Trial access immediately for abuse, suspected fraud, security risk, or violation of these Terms.
  • Trial expiry. At the end of the Trial, your access may be reduced, suspended, or terminated. We do not guarantee that any feature, configuration, or data will remain available after Trial expiry. If we offer export functionality, it will be governed by the Documentation and any applicable contract.

7. FEES, SUBSCRIPTIONS, AND TAXES

Some features of the Services may require payment. Fees, subscription terms, and any additional terms will be presented at the time of purchase or in a separate order form, statement of work, or enterprise agreement. If there is a conflict, the signed enterprise agreement or order form will control.

  • Taxes. Fees are exclusive of applicable taxes unless stated otherwise. You are responsible for taxes associated with your use of the Services, except taxes based on our income.
  • Non-payment. We may suspend or terminate access for non-payment, subject to any applicable contract.

8. LICENSE AND PERMITTED USE

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes during the applicable term. All rights not expressly granted are reserved.

9. API PLATFORM AND PRODUCT API USE

The Services may include APIs that enable automation and integrations (for example, triggering test packs from CI/CD, checking status, and retrieving results). You agree to:

  • Use APIs only as documented and only through authorized authentication methods (including API Keys).
  • Maintain the confidentiality of API Keys and rotate keys if compromise is suspected.
  • Comply with rate limits, throttling, and other technical controls we apply to protect service availability and security.
  • Not attempt to circumvent usage limits or access controls.

We may modify, deprecate, or change APIs from time to time. We will use commercially reasonable efforts to minimize disruption, but we do not guarantee backward compatibility unless agreed in writing.

10. FAIR USE AND ACCEPTABLE USE

You must use the Services responsibly and in a manner that does not harm the Services, other users, or third parties. Without limiting any other restrictions in these Terms, you agree not to (and not to allow others to):

  • Abuse or disrupt the Services, including through denial-of-service, excessive automated requests, runaway CI/CD loops, high-frequency polling, scraping, or interference with platform stability.
  • Circumvent technical controls, including rate limits, quotas, access controls, or security mechanisms.
  • Attack or probe our systems, including scanning, exploit attempts, credential stuffing, malware, or unauthorized testing of the Services or its infrastructure.
  • Test targets without authorization. You represent and warrant that you have permission to test any API, service, or system you configure within the Services. You may not use the Services to test, scan, or interfere with third-party systems without lawful authorization.
  • Submit prohibited data, including secrets, private keys, production credentials, or regulated/sensitive data (for example, health, payment card data, or government identifiers) unless expressly agreed in writing and appropriately protected.
  • Reverse engineer or resell the Services, except to the extent such restrictions are prohibited by applicable law.

We reserve the right to implement safeguards to protect the Services, including monitoring, anomaly detection, logging, throttling, queuing, and temporary blocking of API Keys, users, or IP addresses.

11. CUSTOMER DATA AND PRIVACY

  • Ownership. As between you and us, you retain all rights in Customer Data. We use Customer Data to provide, secure, and improve the Services and as described in our Privacy Policy.
  • Your responsibilities. You are responsible for the legality, accuracy, and content of Customer Data and for ensuring you have rights to submit and process it.
  • Data minimization. Use sanitized test data and avoid introducing sensitive data unless expressly agreed.
  • DPA. If we process personal data on your behalf as a processor, a data processing agreement (“DPA”) may apply and will govern in the event of a conflict with these Terms.

12. AI FEATURES

The Services may provide AI-assisted features (for example, generating suggested tests from API specifications). AI-related functionality is governed by our AI Policy.

  • Validate outputs. AI-generated Outputs may be inaccurate or incomplete. You are responsible for reviewing, testing, and validating any Outputs before relying on them.
  • Third-party AI providers. If you choose to use third-party AI providers, your use may be subject to those providers’ terms and policies. You are responsible for ensuring compliance with your internal data governance requirements.
  • Prohibited AI use. You may not use AI features to submit data you do not have rights to share, or to attempt prompt injection or abuse intended to compromise the Services.

13. INTELLECTUAL PROPERTY, FEEDBACK, AND TRADEMARKS

The Services, Documentation, and all related intellectual property are owned by the Company and its licensors. You may provide feedback or suggestions (“Feedback”). You grant us a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate Feedback without restriction.

“Total Shift Left” and related logos are trademarks of the Company. You may not use our trademarks without our prior written consent, except as permitted by law.

14. CONFIDENTIALITY

You may receive non-public information about the Services. You agree to protect such information using reasonable care and not to disclose it to third parties except as required to use the Services or as permitted by law. Separate NDAs or enterprise agreements may impose additional confidentiality obligations.

15. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR COMPLETE.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO THE COMPANY FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 10,000, WHICHEVER IS GREATER, UNLESS A DIFFERENT CAP IS SET FORTH IN A SIGNED AGREEMENT.

17. INDEMNITY

You agree to indemnify and hold harmless the Company and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your Customer Data, (b) your misuse of the Services, (c) your violation of these Terms, or (d) your testing of any target system without authorization.

18. SUSPENSION AND TERMINATION

We may suspend or terminate your access to the Services (including API access) if we reasonably believe: (a) you have violated these Terms, (b) your use poses a security risk or could harm the Services or others, or (c) required to comply with law. We may also suspend for non-payment, subject to any applicable contract.

Upon termination, your right to use the Services will stop. Provisions that by their nature should survive (including confidentiality, disclaimers, limitations of liability, and indemnity) will survive termination.

19. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
